I'm sure someone will find a way around their detection of a rooted device...
Doesn't seem like a good way to police this. Since a google account follows you from device to device, my rooted nook color would by your suggestion, prevent me from using google movies on a stock device like my cell phone. The determination needs to be device specific at the time of app initiation...it would need to check for something like "s off" or "s on." If not it would be too easy for us to circumvent a denied app download in market by side loading it.They track to see if you are rooted by items downloaded from the market and refused ota's I believe. They can see if you are tethering by data spikes.
