They track to see if you are rooted by items downloaded from the market and refused ota's I believe. They can see if you are tethering by data spikes.

Doesn't seem like a good way to police this. Since a google account follows you from device to device, my rooted nook color would by your suggestion, prevent me from using google movies on a stock device like my cell phone. The determination needs to be device specific at the time of app initiation...it would need to check for something like "s off" or "s on." If not it would be too easy for us to circumvent a denied app download in market by side loading it.

Yea I guess you a right. I read an article a while back that stated this is how they check, but there would be ways around it. So I am not sure how they actually would be able to know that one is rooted.
